(“Podia”, “we”, “us” or “our”) (together with the Site, the “Services”). These Terms of Service set forth the legally binding terms and conditions for your use of the Site and the Services.

Welcome to Mockup Mama LLC (“Mockup Mama,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our websites, pages, courses, communities, digital downloads, and related offerings (collectively, the “Services”). By visiting our site, creating an account, or purchasing any product, you agree to these Terms.
If you do not agree, do not use the Services.
1) Who we are & other policies
Mockup Mama LLC provides educational content, digital downloads, and community access for creators and small business owners. Your use of the Services is also subject to our Privacy Policy and any product-specific terms shown at checkout or within a product area (together, the “Agreement”).

2) Eligibility & accounts
You must be 18+ to purchase. You agree to provide accurate information and to keep your login secure. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms.
3) Intellectual property & permitted use
All course content, videos, audio, prompts, templates, PDFs, images, text, graphics, and other materials are owned by Mockup Mama or our licensors and are protected by IP laws.
We grant you a personal, non-transferable, non-exclusive license to access and use purchased materials for your own business/personal use.
You may not share, resell, reproduce, distribute, make derivatives from, or publicly display our content, nor may you give your login to others.
You may not use our content to create a competing course, template pack, prompt bank, or other substantially similar product.
4) Community standards (The Mockup Lounge)
If your purchase includes The Mockup Lounge or a community space, you agree to be respectful, avoid spam/self-promotion (unless explicitly allowed), and keep the space confidential. We may remove posts or revoke community access at our discretion for violations. Community removal does not entitle you to a refund.
5) Digital products, courses & access
Delivery. Digital products and courses are delivered electronically. Access is typically immediate upon successful payment.
Access term. Courses are provided with lifetime access, subject to change. We may update, move platforms, modify, or retire modules/features to maintain quality and compliance.
Updates. We may update content to reflect best practices, platform changes, or legal requirements.
Tech requirements. You are responsible for having adequate internet, software, and device access.
6) Payments, taxes & refunds
Pricing & payment. Prices are shown at checkout. For Mockup Prompts Made Easy, payment is due in full at purchase. Other products may offer different payment structures, which will be disclosed at checkout.
Taxes. You are responsible for any applicable taxes.
Refunds. Because our products are digital and grant immediate access to proprietary materials, all sales are final unless a specific product page explicitly states a different policy. Any product-specific refund policy will control for that product.
Chargebacks. You agree not to file chargebacks for services delivered as described. If you have an issue, contact us first at tricia@mockupmama.com.
7) Subscriptions & renewals (if applicable)
If a product is sold as a subscription (e.g., membership), the term, price, and renewal schedule will be displayed at checkout. Subscriptions renew automatically until canceled. You can cancel future renewals any time before the next billing date (no prorated refunds for partial periods unless required by law).
8) User content, testimonials & feedback
If you post in our community or submit feedback, testimonials, images, or results (“User Content”), you represent that you own the content and grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display it for educational and marketing purposes, subject to our Privacy Policy. You remain responsible for your User Content.
9) Acceptable use
You agree not to:
violate laws or third-party rights;
upload malware, spam, or harmful code;
scrape, crawl, or attempt to bypass security;
misrepresent your identity;
copy or replicate our content for resale or competition.
We may monitor and enforce these Terms, but we are not obligated to do so.
10) Third-party tools & links
We may integrate with or link to third-party platforms (e.g., Podia, Skool, Stripe, Flodesk, Canva, PayPal, Google Drive). They have their own terms and privacy policies, which apply to your use of those services. We are not responsible for third-party services.
11) Educational & earnings disclaimer
Our content is for educational purposes only. We do not provide legal, tax, accounting, financial, or medical advice. We do not guarantee specific results or earnings. Your outcomes depend on many factors outside our control.
12) Warranties & service availability
The Services are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or virus-free.
13) Limitation of liability
To the maximum extent permitted by law, in no event will Mockup Mama LLC be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the product or service giving rise to the claim in the three (3) months preceding the event, or $500, whichever is greater.
14) Indemnification
You agree to indemnify and hold harmless Mockup Mama LLC and our officers, employees, contractors, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services, your breach of these Terms, or your violation of third-party rights.
15) DMCA & IP concerns
If you believe material on our site infringes your copyright, email tricia@mockupmama.com with: (a) your contact info, (b) identification of the work claimed infringed, (c) the URL or location of the material, (d) a statement under penalty of perjury that you have a good-faith belief the use is not authorized, and (e) your signature. We may remove content at our discretion.
16) Changes to the Services or Terms
We may update the Services and these Terms from time to time. The current version will be posted on our site with the “Last updated” date. Your continued use after changes constitutes acceptance of the updated Terms.
17) Governing law & venue
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Washington State for any dispute arising from or related to the Services.
Optional arbitration/class waiver language can be added if you want it—omitted here for simplicity and flexibility.
18) Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., acts of God, internet outages, platform changes, labor disputes, or governmental actions).
19) Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
20) Entire agreement; severability; waiver; notices
These Terms (plus any product-specific terms and our Privacy Policy) are the entire agreement between you and us. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You consent to receive notices electronically at the email you provided or via our site.
